Texas Racing Commission Issues Revised Returned Check Policy

Beginning on August 1, 2009, an individual that submits a check that is returned for Non Sufficient Funds (NSF) will be referred to the Board of Stewards/Judges for a violation of the Texas Racing Act and the Rule of Racing. Checks returned for other reasons, such as “No Account” or “Account Closed’ will also be referred to the Board of Stewards/Judges.

The Board of Stewards/Judges may issue a Notice of Alleged Violation to the licensee and conduct a hearing on the matter. The penalty for submitting a check that is returned to the Texas Racing Commission because of insufficient funds or closed account may result in a $50 fine per check and possible suspension of the occupational license.

This policy will allow the Commission to recover a portion of the administrative costs associated with processing returned checks.
